Draw: The Draw is operated by the Promoter, to which these terms and conditions apply.

Question: The Question that the Entrant must correctly answer in order to proceed to have the opportunity to win the Prize (in accordance with the Gambling Commission’s Rules and Guidelines regarding Skilled Prize Draw)
Entry: The Entry is the ability to correctly answer the randomly chosen Question set by the Promoter, in conjunction with the payment of £25.00 GBP each through the Website or free of charge by Post
Entrant: The Entrant is any person who enters the Draw through the Website or via postal application to try and win the Prize. Businesses, corporations or limited liability partnerships are excluded from entering. Each Entrant must be over the age of 18 to enter the Draw
Winner: The Entrant that is chosen at random on the Draw date by an independent random number generator.
Start Date: Friday 28th August 2020 at 12pm
Draw Closure: The Draw will close on January 29th at 12pm
Maximum Number of Paid Entries: 20,000, if this threshold is met Villa Giardino will be awarded as the Prize
General Draw Terms
By entering the Draw via the Website or by post, Entrants are deemed to have read and accepted these Terms and Conditions and agree to be bound by them.
The Draw is organised & run by the Promoters.
To notify Entrants of any changes or developments in the Draw
To notify the Winner they have won the Prize
To announce the Winner on the Website and all other linked social media
The Entrant is solely & completely responsible for providing their correct contact information to the Promoter. The Promoter is not liable for any inability or failure to contact the Entrant due to inaccurate, errors or omissions in the contact information provided by the Entrant or otherwise. Should the Promoter be unable to contact the Winner of the Draw due to inaccurate contact information within 3 weeks, the Winner will forfeit their right to the Prize and the Promoter will choose a new Winner.
The Entrant agrees to allow the Promoter to store and use their contact information and any other personal data collected in accordance with the General Data Protection Regulation (GDPR), for the purpose of running the Website and Draw.
The Entrant agrees to allow the Promoter (either by choice or at the request of a third party) to share their contact information and personal data provided to relevant third parties for the purpose of preventing fraud, money laundering, or any other legal or regulatory reasons.
The data will not be sold to or used by third parties, and will be used by the Promoter to update Entrants for the duration of the Draw and future Draws
The Draw is open to anyone aged 18 or over, excluding the Promoters and their immediate family members, advisors, employees or anyone associated with the running of the Website and or the Draw in any way, shape or form.
Entries must be submitted via the Website www.winhousesinitaly.com or by post to 3a Excelsior Road, Poole, BH14 8TT and contain the answer to the Question, the Entrant’s full name, date of birth, address, telephone number and email address.
By entering the Draw, all Entrants acknowledge that payment of £25.00 GBP per Entry or submitting a free postal Entry and a correctly answered Question does not in any way guarantee they will win the Prize.
All postal Entries are free of charge. Each postal entry must be submitted on an individual postcard and sent with a first-class stamp. Postal entries will only be accepted by UK residents. Each postcard must contain the Entrant’s name, date of birth, address, telephone number and email address, and the answer to the Question. Entry postcards sent in envelopes will not be accepted and the entries will be void. Each postal entry must be submitted individually to:

The Promoter does not in any way guarantee the value of the Prize and makes no representation or warranty in respect of its accuracy.
The price of £25.00 GBP per paid Entry is set by the Promoter, using the payment gateway Trust Payments
As a condition of entering the Draw, Entrants must ensure that, by doing so they do not contravene any laws of their country of residence. The Promoter will not be liable in any way if the Entrant enters the Draw unlawfully.
By entering the Draw the Entrant acknowledges the Promoter’s right to disqualify, entirely at their own discretion, any Entrant or Entry, in the event that the Terms and Conditions are breached, including but not limited to inaccurate or untrue information being submitted.
There is no limit to the number of Entries that can be made by any one person via the Website (although the total number of paid tickets available is set at 20,000), but all Entries must adhere to the aforementioned Terms and Conditions.
Paid and free postal entries will be treated exactly the same, as long as all conditions are met.
Each Entry to the Draw along with the correct answer to the Question entitles the Entrant to one chance to win the Prize; for example, 50 Entries with the correct answer gives the entrant 50 chances to win the Prize.
The Promoter will stop accepting free Entries when the number of available free Entries, which is equal to the Maximum Number of Paid Entries, or the Draw closes because all paid Entries have been sold.
Only completed Entries made in accordance to these Terms and Conditions will be admitted to the final Prize Draw.
All Entries automatically become property of the Promoter upon receipt and will not be returned.
The Prize is awarded in its current state. The Promoter provides no guarantee or Warranty regarding the valuation, condition, structural or cosmetic condition or its ability to be sold. The Winner of the Prize should undertake their own enquiries regarding the property; including commissioning their own Chartered Building Survey should they deem it necessary. The Entrant acknowledges they are solely responsible for satisfying themselves regarding the condition and accuracy of the Prize description.
The Promoter reserves the right to amend these Terms and Conditions at any time & for any reason. All Draw Entrant’s shall be notified of any changes and will have a period of 14 days to object to any amendments or request a full refund of the Entry.
If the Winner is or becomes ineligible to win the Prize, fails to comply with the Terms and Conditions or cannot proceed with the Draw within 28 days from the date of the Draw, an alternate Winner will be chosen by selecting a new unique reference number
The Entrants and the Promoters recognise that the transfer of ownership of the Prize is strictly governed by Italian Law, and the Draw itself and its associated activities by UK law.
The Promoters and Entrants recognise that the conditions under which the Draw is run are governed by English Law, and that in the event of any dispute, the English courts have sole jurisdiction.
The Promoters, employees and agents will not be liable for any loss, economic or otherwise, suffered to or sustained by any person or property as a result of any act or omission, during or following the distribution of the Prize to the Winner.
The Promoters accept no liability for errors or omissions contained within the Prize details, description or specification or any other part of the Website. It is the responsibility of each Entrant (and in particular the Winner) to satisfy themselves as to the accuracy of any such details and/or any content of this Website.
The Promoter will not be liable for any loss suffered by an Entrant as a result of incomplete Entries or failed computer communications, other malfunctions high internet traffic, hardware failure, software failure, server faults, merchant transaction malfunctions, postal service delays/not received or any other reason or for any loss suffered as a result of the Website
The Draw rules shall not create or be construed as creating any form of contract, joint venture or other agreement between any Entrant and the Promoters.
In the case of a force majeure event intervening in the Draw, the Draw may close and the Prize be awarded or refunds provided to those who have paid to enter, at the discretion of the Promoter.
Each Entrant should retain a copy of these Terms and Conditions for their future reference.
Entrants agree that the usual requirements under The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 for goods and services ordered on line to be supplied within 30 days will not apply to this Draw.
An Entry shall be declared void (without any refund being given) if the Entrant engages in
Any form of fraud (actual or apparent)
Hacking or interference with the proper functioning of the Website
Amending or unauthorised use of, any of the code that constitutes the Website
The cost of entering the Draw is £25.00 GBP per Entry, and is payable via the Website using the “Enter Now” button. All payments must be made through the Promoter’s chosen payment Gateway www.trustpayments.com, and must adhere to the Gateways’ Terms and Conditions. Alternatively postal entries can be made free of charge, as outlined in the Terms and Conditions.

All Entries via www.winhousesinitaly.com will be asked to provide their contact details, e-mail address & telephone number plus card payment details. The Entrant will provide payment information (for example credit or debit card information), and payment will be taken from the Entrant for the number of Entries they have selected to purchase. Once the payment details have successfully been entered the Entrant will be promoted to answer a multiple choice question, upon submitting an answer to the question and providing contact information, the entrant will confirm completion & be sent an electronic receipt via email which will also contain a unique reference number.
The Entrant acknowledges that Entries, purchased or sent by post, are only submitted to the final Prize draw if they have correctly answered the Question set by the Promoter, in accordance with the Gambling Commission Guidelines on Skilled Prize Competitions. The Promoter’s decision is final.
After payment has been submitted and confirmed via the Website, each Entrant will be provided with a Unique Reference Link (URL) that they can share online. The Entrant who generates the most Entry sales through sharing their personalised URL link will be awarded a £10,000 cash prize (in the event of a tie the cash prize will be divided equally). If the actual number of Entries sold is less than the Maximum Number of Paid Entries required to award the Prize, the Promoter will not award the £10,000 cash prize.
When the Maximum Number of Paid Entries (20,000) is reached, the Draw will close and no further Entries will be accepted
The Winner will be decided within 14 days the Draw Closure.
The Promoter will draw the Winner at random using an online number generator, from the Entries that have been assigned a unique reference number. None of the Entrants’ personal information will be associated with deciding the Winner. The Draw will take place under the supervision of a UK & Italian solicitor.
All Entries to the Draw are final and no refunds shall be made at any time or for any reason. Once the Winner has been chosen, the Promoter’s decision is final and no further correspondence will be engaged in regarding the result of the Draw.
The Promoter will attempt to contact the Winner by phone and email. If the Winner cannot be contacted by the Promoter within 28 days of the Draw the Promoter shall be entitled to undertake a new Draw to determine a new Winner. This process will continue until a Winner has been contacted and successfully confirmed their identity with the Promoter.
The Winner will be required to forward a copy of their passport or driving licence to the Promoter to prove their identity and that their Entry (if via paid Entry method) was made using a valid payment means belonging to the entrant or used with the express authorisation of the card holder.
The Winner will be required to travel to Italy, to sign a transfer deed to transfer the property into the Winners name within 28 days of being notified. Expenses for 2 x European flights, 2 days car hire and hotel will be covered.
All monies generated from Entry fees will be securely held in a separate bank account by the Promoter until the Winner of the Draw has been determined.
The Winner shall ensure that the Prize is registered at the local town hall and land registry is in the Winners name
English is the only language in which the Entrant may submit their Entry
Each Entrant agrees that the usual requirements under [the Consumer Protection (Distance Selling) Regulations 2000] for any goods and services ordered online to be supplied with 30 days will not apply to this Draw
The Promoter reserves the right to cancel the Draw at any time either before or after Entries have been sold. If the Draw is cancelled, the Promoters will return the Entry fees to each Entrant by bank card refund or cheque in one combined payment where several Entries have been made by the Entrant. Where the Entry fee is returned, the Promoter shall have no further liability to the Entrant or to any other person.
The main purpose of the Draw is to win the Prize. Further details regarding the Prize can be found on the Promoter’s Website.
The Prize, will be transferred by the Promoter to the Winner free of any mortgages, charges and other encumbrances, at the Promoter’s expense and including all fee’s charges and Italian house purchase taxes.
The Promoter is not responsible for any taxes incurred in the Entrant’s country for winning an overseas property and it is the Entrant’s responsibility to know if any taxes are due.
Additionally, if the Maximum Number of Paid Entries, 20K has been reached, the Promoter will announce the name of the Entrant who generated the most Entry sales through sharing their personalised URL link. This individual will be awarded a £10,000 cash prize. If the actual number of Entries sold is less than the Maximum number of Paid Entries, 20K, the Promoter will not award the £10,000 cash prize.
Closing the Draw
The Draw will close automatically when either a) 20,000 Entries are sold or b) 5 months from the Start Date, whichever shall occur first. The Promoter reserves the right, at its sole discretion, and at any time during the initial 5 months from the Start Date to extend the automatic Draw Closure by a further 5 months.
All Draw Entrants shall be notified of any changes to the Draw Closure and will have a period of 14 days to object to any amendments or request a full refund of any Entries purchased.
If the Maximum Number of Paid Entries (20,000) to the Draw is not reached and the Draw is closed, at the sole discretion of the Promoter either:
a) the proceeds will be deemed sufficient by the Promoters to award the Prize, or
b) the remaining funds will be allocated as a cash prize to a Winner after the deduction of 20% for expenses and marketing fee’s plus a 10% charity donation
